{"id":51877,"date":"2025-01-22T10:43:38","date_gmt":"2025-01-22T13:43:38","guid":{"rendered":"https:\/\/www.mpal.mp.br\/?p=51877"},"modified":"2025-01-22T10:44:36","modified_gmt":"2025-01-22T13:44:36","slug":"mpal-denuncia-envolvidos-na-operacao-circuito-fechado-e-pede-devolucao-de-meio-bilhao","status":"publish","type":"post","link":"https:\/\/www.mpal.mp.br\/?p=51877","title":{"rendered":"MPAL denuncia envolvidos na opera\u00e7\u00e3o Circuito Fechado e pede devolu\u00e7\u00e3o de meio bilh\u00e3o"},"content":{"rendered":"<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\"><span style=\"color: #000000;\">O<\/span><span style=\"color: #000000;\"> Minist\u00e9rio P\u00fablico <\/span><span style=\"color: #000000;\">do Estado de Alagoas (MPAL), por meio do Grupo de Atua\u00e7\u00e3o Especial de Combate \u00e0 Sonega\u00e7\u00e3o Fiscal e Lavagem de Bens (Gaesf), denunciou oito pessoas que foram alvo da opera\u00e7\u00e3o Circuito Fechado, desencadeada <\/span><span style=\"color: #000000;\">em dezembro<\/span><span style=\"color: #000000;\"> do ano passado. <\/span><span style=\"color: #000000;\">A partir da an\u00e1lise dos dados obtidos durante a investiga\u00e7\u00e3o, <\/span><span style=\"color: #000000;\">ficou comprovado o envolvimento de cada uma delas nos crimes de <\/span><span style=\"color: #000000;\">organiza\u00e7\u00e3o criminos<\/span><span style=\"color: #000000;\">a <\/span><span style=\"color: #000000;\">(orcrim)<\/span><span style=\"color: #000000;\">,<\/span><span style=\"color: #000000;\"> sonega\u00e7\u00e3o fiscal e falsidade ideol\u00f3gica. <\/span><span style=\"color: #000000;\">O Gaesf pede repara\u00e7\u00e3o aos cofres p\u00fablicos em mais de meio bilh\u00e3o <\/span><span style=\"color: #000000;\">de reais <\/span><span style=\"color: #000000;\">e a condena\u00e7\u00e3o dos denunciados por dano moral coletivo. <\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\"><span style=\"color: #000000;\">Na apura\u00e7\u00e3o do Gaesf, ap\u00f3s a deflagra\u00e7\u00e3o da opera\u00e7\u00e3o que cumpriu <\/span><span style=\"color: #000000;\">14 mandados judiciais de busca e apreens\u00e3o <\/span><span style=\"color: #000000;\">contra<\/span><span style=\"color: #000000;\"> 12 pessoas f\u00edsicas <\/span><span style=\"color: #000000;\">e <\/span><span style=\"color: #000000;\">jur\u00eddicas, <\/span><span style=\"color: #000000;\">cujas resid\u00eancia<\/span><span style=\"color: #000000;\">s<\/span><span style=\"color: #000000;\"> e empresas est\u00e3o localizadas<\/span><span style=\"color: #000000;\"> na Ponta Verde <\/span><span style=\"color: #000000;\">e na <\/span><span style=\"color: #000000;\">parte alta da cidade <\/span><span style=\"color: #000000;\">de Macei\u00f3, <\/span><span style=\"color: #000000;\">constatou-se<\/span><span style=\"color: #000000;\"> que o grupo praticava fraudes estruturadas, como falsifica\u00e7\u00e3o de documentos e manipula\u00e7\u00e3o societ\u00e1ria, com o objetivo de obter vantagens il\u00edcitas e enriquecer de forma indevida. Para viabilizar os crimes, a organiza\u00e7\u00e3o contava com a participa\u00e7\u00e3o de contadores, advogados, empres\u00e1rios, \u201ctestas de ferro\u201d e \u201claranjas\u201d.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\"><span style=\"color: #000000;\">Todo o material apreendido <\/span><span style=\"color: #000000;\">\u00e0 \u00e9poca, <\/span><span style=\"color: #000000;\">como <\/span><span style=\"color: #000000;\">aparelhos<\/span><span style=\"color: #000000;\"> eletr\u00f4nicos, ve\u00edculos <\/span><span style=\"color: #000000;\">e documentos, serviram de base para o ajuizamento da a\u00e7\u00e3o <\/span><span style=\"color: #000000;\">proposta pelo G<\/span><span style=\"color: #000000;\">aesf, <\/span><span style=\"color: #000000;\">que detalha, dentre outras coisas, como a orcrim <\/span><span style=\"color: #000000;\">praticou o crime <\/span><span style=\"color: #000000;\">previsto na <\/span><span style=\"color: #000000;\">Lei n.\u00ba 8.137\/90, <\/span><span style=\"color: #000000;\">que trata sobre <\/span><span style=\"color: #000000;\"> sonega\u00e7\u00e3o <\/span><span style=\"color: #000000;\">de impostos, <\/span><span style=\"color: #000000;\">e <\/span><span style=\"color: #000000;\">f<\/span><span style=\"color: #000000;\">alsidade ideol\u00f3gica, <\/span><span style=\"color: #000000;\">tratado no <\/span><span style=\"color: #000000;\">art. 299 do C\u00f3digo Penal <\/span><span style=\"color: #000000;\">b<\/span><span style=\"color: #000000;\">r<\/span><span style=\"color: #000000;\">asileiro. <\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\"><span style=\"color: #000000;\">A a\u00e7\u00e3o penal requer <\/span><span style=\"color: #000000;\">a condena\u00e7\u00e3o em repara\u00e7\u00e3o m\u00ednima no valor de R$ 502.503.647,88 (quinhentos e dois milh\u00f5es de reais, quinhentos e tr\u00eas mil seiscentos e quarenta e sete reais e oitenta e oito centavos) e fixa\u00e7\u00e3o de danos morais coletivos.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"color: #000000; font-family: helvetica, arial, sans-serif; font-size: 12pt;\"><b>Dados do Coaf <\/b><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\"><span style=\"color: #000000;\">Os <\/span><span style=\"color: #000000;\">denunciados <\/span><span style=\"color: #000000;\">atuavam em um esquema desenvolvido a partir de diversas sucess\u00f5es empresariais no ramo de supermercados, com utiliza\u00e7\u00e3o de pessoas interpostas <\/span><span style=\"color: #000000;\">e <\/span><span style=\"color: #000000;\">s\u00f3cios-laranjas, visando o n\u00e3o pagamento das d\u00edvidas tribut\u00e1rias das empresas sucedidas, <\/span><span style=\"color: #000000;\">resultando no ganho<\/span><span style=\"color: #000000;\"> de lucros ilegais. <\/span><span style=\"color: #000000;\">Ap\u00f3s ter acesso <\/span><span style=\"color: #000000;\">aos dados do <\/span><span style=\"color: #474747;\">Conselho de Controle de Atividades Financeiras (<\/span><em><span style=\"color: #767676;\">COAF<\/span><\/em><span style=\"color: #474747;\">),<\/span><span style=\"color: #474747;\">o Gaesf <\/span><span style=\"color: #474747;\">constatou <\/span><span style=\"color: #000000;\">transa\u00e7\u00f5es financeiras de alto valor e natureza suspeita, com potencial enquadramento em crimes financeiros como lavagem de dinheiro e sonega\u00e7\u00e3o fiscal.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"justify\"><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\"><span style=\"color: #000000;\">E n\u00e3o \u00e9 a primeira vez que o<\/span><span style=\"color: #000000;\"> s\u00f3cio oculto das empresas e l\u00edder da <\/span><span style=\"color: #000000;\">orcrim<\/span><span style=\"color: #000000;\"> foi alvo <\/span><span style=\"color: #000000;\">de <\/span><span style=\"color: #000000;\">apura\u00e7\u00e3o envolvendo o cometimento de crime<\/span><span style=\"color: #000000;\">s<\/span><span style=\"color: #000000;\">. <\/span><span style=\"color: #000000;\">E<\/span><span style=\"color: #000000;\">m <\/span><span style=\"color: #000000;\">junho de 2019, <\/span><span style=\"color: #000000;\">ele <\/span><span style=\"color: #000000;\">esteve dentre os <\/span><span style=\"color: #000000;\">investigados <\/span><span style=\"color: #000000;\">na <\/span><span style=\"color: #000000;\">o<\/span><span style=\"color: #000000;\">pera\u00e7\u00e3o Camale\u00e3o, deflagrada pela Pol\u00edcia Federal. <\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\"><strong><span style=\"color: #000000;\"><b>Composi\u00e7\u00e3o do Gaesf<\/b><\/span><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000; font-family: helvetica, arial, sans-serif;
