{"id":50325,"date":"2024-11-28T14:29:33","date_gmt":"2024-11-28T17:29:33","guid":{"rendered":"https:\/\/www.mpal.mp.br\/?p=50325"},"modified":"2024-11-28T14:31:11","modified_gmt":"2024-11-28T17:31:11","slug":"procuradoria-de-justica-civel-celebra-anpc-em-acao-de-improbidade-administrativa","status":"publish","type":"post","link":"https:\/\/www.mpal.mp.br\/?p=50325","title":{"rendered":"Procuradoria de Justi\u00e7a C\u00edvel celebra ANPC em a\u00e7\u00e3o de improbidade administrativa"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: helvetica, arial, sans-serif;\">O Minist\u00e9rio P\u00fablico do Estado de Alagoas (MPAL), por meio da Procuradoria de Justi\u00e7a C\u00edvel, celebrou Acordo de N\u00e3o Persecu\u00e7\u00e3o C\u00edvel (ANPC) na a\u00e7\u00e3o de improbidade administrativa n\u00ba 0001778-59.2009.8.02.0001, que se encontra em grau de recurso no Tribunal de Justi\u00e7a do Estado de Alagoas. O acordo foi firmado com o representante de uma empresa localizada na capital alagoana e agora est\u00e1 aguardando homologa\u00e7\u00e3o judicial.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: helvetica, arial, sans-serif;\">A a\u00e7\u00e3o, proposta pelo MP em primeiro grau, obteve a condena\u00e7\u00e3o, com base no artigo 11, inciso I, da Lei de Improbidade Administrativa (Lei 8.429\/92). Em grau de recurso, o 7\u00ba cargo da Procuradoria de Justi\u00e7a C\u00edvel buscou a autocomposi\u00e7\u00e3o, garantindo o ressarcimento ao er\u00e1rio. Na \u00e9poca do fato, o valor dos bens n\u00e3o devolvidos equivalia a R$ 2.478,11. No acordo, foi fixado o referido valor, devidamente corrigido, bem como o pagamento de multa civil.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: helvetica, arial, sans-serif;\">O procurador de Justi\u00e7a Isaac Sandes, coordenador da Procuradoria de Justi\u00e7a C\u00edvel, ressaltou que a pr\u00e1tica da autocomposi\u00e7\u00e3o vem sendo incentivada como alternativa para a resolu\u00e7\u00e3o de conflitos, promovendo maior celeridade e efici\u00eancia na defesa do patrim\u00f4nio p\u00fablico.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: helvetica, arial, sans-serif;\">\u201cO ANPC reflete o esfor\u00e7o do MPAL em promover a resolu\u00e7\u00e3o \u00e1gil e eficiente de conflitos, garantindo a repara\u00e7\u00e3o do patrim\u00f4nio p\u00fablico e desonerando o Poder Judici\u00e1rio. Com a homologa\u00e7\u00e3o judicial, busca-se uma solu\u00e7\u00e3o c\u00e9lere, preservando os princ\u00edpios constitucionais e evitando a morosidade de recursos judiciais\u201d, afirmou Isaac Sandes.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: helvetica, arial, sans-serif;\">Termos do Acordo<\/span><\/p>\n<p><span style=\"font-family: helvetica, arial, sans-serif;\">Entre os principais pontos do acordo est\u00e3o:<\/span><br \/>\n<span style=\"font-family: helvetica, arial, sans-serif;\">&#8211; Repara\u00e7\u00e3o do dano: Levantamento do dep\u00f3sito judicial correspondente ao valor do dano, para a recomposi\u00e7\u00e3o do patrim\u00f4nio p\u00fablico.<\/span><br \/>\n<span style=\"font-family: helvetica, arial, sans-serif;\">&#8211; Multa civil: Pagamento revertido em benef\u00edcio do er\u00e1rio.<\/span><br \/>\n<span style=\"font-family: helvetica, arial, sans-serif;\">&#8211; Suspens\u00e3o do processo: A a\u00e7\u00e3o permanecer\u00e1 suspensa at\u00e9 o cumprimento integral das obriga\u00e7\u00f5es.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: helvetica, arial, sans-serif;\">O descumprimento dos termos resultar\u00e1 na retomada do processo judicial.
